Course Enrollment Terms & Conditions for MahaVastu® Courses
Please read the following terms & conditions carefully. These terms & conditions apply to anyone starting a course with “MahaVastu Corporation LLP”. These terms and conditions (Read till end to enable Pay Now button) are a contract between You (“User”) and MahaVastu Corporation LLP (“MahaVastu®”). These T&C contain important information about your rights and obligations as well as limitations and exclusions that may apply to You.
Terms of Use of this Website & Related Content:
- This website is owned and operated by “MahaVastu Corporation LLP” under the brand name “MahaVastu®”. The company name will be referred to as “MahaVastu®” hereinafter.
- All intellectual property rights, including copyright in all content and communication of the Website and Course Material belongs to “MahaVastu®”. By reading the Terms of Use you are agreeing that the content and property of “MahaVastu®” cannot be copied, reproduced, modified, stored, redistributed or exploited commercially in any way without written permission from “MahaVastu®”.
- “MahaVastu®” may change the content, which includes prices, offers and content at any time. We do not provide a warranty or guarantee of its accuracy, completeness, suitability, timeliness or performance of information or content on the website. If there are errors in the information provided in the content of the website, we expressly exclude liability for these inaccuracies, to the fullest extent that the law permits.
- You are free to use any of the information or content at your own risk for which “MahaVastu®” shall not be liable. It will be your responsibility to ensure that any product/service you purchase are suitable to your current requirements.
- You represent that the information provided by you at the time of the enrolment are correct, true and accurate, and you agree to update the same as and when there is any change in the said information.
- By sharing your information during the course, you give your consent to MahaVastu® to save and use that information to contact you, send you updates and promotional information about new courses and products. MahaVastu® is also authorised to use such information after completion of the course.
Definition of Online Courses:
- MahaVastu® offers multiple courses including MahaVastu® Foundation Course, MahaVastu® Expert Course, Vastu Purush Mandala Devta Course, Vedic Astrology Foundation Course, Astro MahaVastu® Remedies Course, Factory MahaVastu® Course, Intuitive Advanced MahaVastu® Course and all other courses conducted by MahaVastu® (“Course”).
- The Course being offered to you, is aimed at familiarizing you with the methodology used by MahaVastu® and imparting knowledge of the techniques practiced by MahaVastu® and its approved trainers (“Trainers”), Consultants/Advisors (“Advisors”) and mentors (“Mentors”). You admit that enrollment in any Course is voluntary and out of your free will without any influence of any advertisement, claim, pressure, promise or representation of any kind whatsoever from any person including any employee/teacher/ instructor/ associate of MahaVastu®.
- Kindly note that Vastu Vidya is a broader knowledge about architecture and design theories from ancient India. Vastu Vidya knowledge is a collection of ideas and concepts, with or without the support of layout diagrams, that are not rigid. Rather, these ideas and concepts are models for the organization of space and form within a building or collection of buildings, based on their functions in relation to each other, their usage and the overall fabric of the Vastu.
- The Courses offered by MahaVastu® are neither architectural courses nor Spiritual discourses nor Design Courses, although they do contain some elements of each. These Courses are based on Science as learnt through research and case studies compiled by Dr. Khushdeep Bansal.
Course Fee:
- Course fee is only valid for the duration of the Course opted by you and is non-refundable. You may apply to repeat the Course in case you are not able to attend the same after enrollment and the decision of your re-enrolment including settlement of payment of the Course fee will be at the sole discretion of MahaVastu®.
- In case of any cancellation of the Course for any reason whatsoever, MahaVastu®’s responsibility will be limited to informing the payment gateway, within a reasonable period of time (not exceeding 5 (five) working days from date of cancellation), to enable the payment gateway to process the refund through their appropriate channels. Under no circumstances shall MahaVastu® be held liable for any loss occasioned to you on account of cancellation of the Course.
Certificate:
- At the End of the Course you shall be given a Certificate showing you have successfully completed this Course. The Certificate shall be issued in accordance with the Course Description and shall adhere to the Terms and Teachings as applicable to that particular Course. Whether the Course prepares you to take on commercial consulting depends on the Course attended, its Description and the Teachings imparted.
Purchase of Online Resources from MahaVastu®:
- The product “Horoscope” is aimed at familiarizing You with the methods of horoscope reading and understanding and are for educational and illustrative purposes only and not for any other purpose whatsoever at all. They may be purchased as a standalone product or as part of Astro MahaVastu® Remedies Course (AMRC).
- The techniques of horoscope reading imparted in Astro MahaVastu® Remedies Course or “Horoscope” are based on algorithmic interpretation of text-based knowledge and MahaVastu® does not take any responsibility in the accuracy thereof. The said reading of horoscope shall not be relied upon by You for any advisory / commercial purpose. It is not a definitive reading.
- The Product Digital Shakti Charka available as an android / iOS application, is copyright of Dr. Khushdeep Bansal and MahaVastu® has all the rights to use the same including prosecution for its misuse / violation.
- Any Books or written material authored by Dr. Khushdeep Bansal is his original work and copyright. MahaVastu® has all the rights to use the same including prosecution for its misuse / violation by any other person.
- Any material procured from different sources other than those authored by Dr. Khushdeep Bansal is solely for facilitating the course and MahaVastu® is not liable for any information that shall be obtained due to the content of such material. Any other use of such material apart from those instances where material is relied upon by MahaVastu® is the responsibility of the user.
- All materials and content, which include images, text, layout, graphics, design and appearance belong to “MahaVastu®”. Their reproduction in either copied or derivative format or disparaged format is illegal. Any breach of these terms may result in a criminal offense being committed, in addition to a claim for damages.
- The teachings and training materials shared with you, i.e., Course Material, are based upon the research and case studies compiled by Dr. Khushdeep Bansal, Founder of MahaVastu®.You acknowledge that the trade mark MahaVastu® and all the materials provided to you and/ or accessed by you in any form which include images, text, layout, graphics, design and appearance, constitute the intellectual property of Dr. Khushdeep Bansal and is protected under relevant laws.
- MahaVastu® has obtained rights from Dr. Khushdeep Bansal to use the intellectual property owned by him for the limited purpose of the Course. You are not allowed to copy, reproduce, sell, publish, display, transmit, distribute, perform, modify, create works derivative of, or in any way exploit any material from the Course without the express written consent of MahaVastu®.
- Use of a camera/ phone to record the teachings/ techniques of MahaVastu®, copying or reproducing the same in any audio, video, electronic, multimedia, photographic, and written forms, now known or those which will come into existence in the future amounts to infringement/ violation of the intellectual property rights and shall be actionable under the law. The use of camera / phone to record the teachings of MahaVastu® during the Course or otherwise are strictly not allowed.
- In case you wish to use the teachings and training materials used in the Course for reprinting, publishing, licensing or for any other purpose, you ought to seek permission in writing from MahaVastu® by addressing a letter to [email protected] stating your residence country, state, city, your name, contact number, organization’s name, postal address, purpose and mission of your organization, details of the desired teaching and training material/s to be utilized, details about where you wish to utilize or publish the teaching and training material/s and a detailed description of the purpose of using said teaching and training material/s. Any deviation from the above shall invite recourse to law to protect the Intellectual Property.
- If permission is granted, and You reproduce the content as it, it will be mandatory to give recognition to MahaVastu® and if you publish afresh, but is derived from our material, then You will have to give state that the content is derived from MahaVastu® and also give a Disclaimer that MahaVastu® is not liable for any discrepancies of your derived content.
- MahaVastu® reserves all rights to refuse such requests for permission without providing any explanation. MahaVastu® also reserves rights to withdraw any such permission(s) at a 3 (three) weeks’ notice and continuation of usage against any such withdrawal will be considered an infringement/violation of the intellectual property rights vesting in the material(s).
Confidential Information/ Proprietary Information:
- You agree to make use of the Confidential Information/ Proprietary Information (‘Confidential Information’ or ‘Proprietary Information’ shall include any publication or article or data or information or material through any medium shared with you whether or not the same is novel, unique, patentable, copyrightable, or constitute a trade secret) solely for the purpose intended and in connection with the current or contemplated association between MahaVastu® and You and not for any purpose, unless otherwise authorized by prior written consent by an authorized representative of MahaVastu®.
- There shall be no right or license, whether expressed or implied, in the Confidential Information/ Proprietary Information disclosed to you at any point of time. Ownership and title to the Confidential Information/ Proprietary Information shall remain solely with MahaVastu®. Further, you shall not use or attempt to use any of the Confidential Information/Proprietary Information in any manner which may cause or be calculated to cause injury or loss to MahaVastu® and shall be met with Legal Action.
Limitations of Liability on MahaVastu® & Obligations on Trainees:
- You recognize and agree that no promises and/or representations and/or assurances have been held out to you as to how you would fare professionally after completion of the Course.
- You are aware that the Course is a stepping stone designed to assist you in achieving proficiency in techniques and teachings adopted by Trainers, Advisors and Mentors of MahaVastu®. However, neither MahaVastu® nor its Trainers/Advisors/ Mentors guarantee, assure or promise that You will be able to impart training and/ or provide teaching as a “Certified MahaVastu® Trainer or Mentor” and/ or render advice on the learnings and techniques disseminated in the Course opted by You.
- MahaVastu® does not guarantee any results from the techniques and learnings disseminated in the Course including those suggested by a “Certified MahaVastu® Trainer/Advisor/ Mentor” during the Course. Like any other professional service, the methodology used by MahaVastu® also requires skills in application and expert advice under regular observation of a subject matter expert.
- MahaVastu® and its Mentors, Advisors and Trainers do not guarantee, ensure or promise learning by You in understanding and mastering skills with MahaVastu® Methodology. Learnings from the MahaVastu® Course solely depend upon your own understanding, intellectual capability, personal approach, ability to comprehend and practice of taught procedures. MahaVastu® is solely imparting knowledge but does not guarantee that You imbibe and learn the same in the manner taught to You.
- Since all the teachings are provided in the Course and the payment is also only made for the Course, after completion of the Course, MahaVastu® is not liable to provide any post-course support to you.
- The Trainers/Advisors/ Mentors of MahaVastu® may run Self-Help groups voluntarily post imparting of Training to you at the Course. These self-help type groups are not run or controlled by MahaVastu® in any manner whatsoever. They are a prerogative of the respective Trainer as they may be required to further impart Training through volunteering self-help type groups. You may be asked to join these Groups at your own Will and your joining or removal from such volunteering group and shall be decided by the Trainers and/ or Mentors depending upon your moral conduct, behavior, positive attitude, intent and understanding. Harassment of Group members, Obscenity and/or violent conduct, etc. shall not be tolerated in any manner whatsoever. MahaVastu® is neither responsible nor liable in any manner for your participation or exclusion from any such volunteer work for any reason whatsoever that is solely dependent on Your conduct.
- MahaVastu® and the Trainers/Advisors/ Mentors have the unfettered right to prohibit you from using and/ or accessing the material/s used for teachings and trainings, social networking group/s and/ or digital social media platform/s managed by MahaVastu® at its sole discretion, without giving any warning, intimation, written notice and/or assigning any reason whatsoever.
- The online/ offline support provided by MahaVastu® and/or any digital social media platform/s created at the sole discretion of MahaVastu® may be discontinued and/or your access to online/offline support/ social media platform/s prohibited/restricted without any prior notice to you. You shall have no recourse if any such support and/or social media platform/s is/are inaccessible/discontinued/varied.
- You are expected to conduct yourself in a manner which is conducive to learning. MahaVastu® and its Trainers/Advisors/ Mentors expect appropriate respectful behavior, social and moral conduct, and positive attitude towards fellow course mates and Trainers/Mentors. Contravention of these expectations and/ or Harassment of Trainers/ Mentors/ Fellow Trainees shall result in consequences that may call for legal action, including criminal action, if warranted, under the law. Such behavior shall also make You liable for immediate dismissal from the Course/ Group, without any explanation on the sole decision of MahaVastu®. No refund shall be processed in such a case either.
- MahaVastu® shall not, in any circumstances, be liable to you for any special, indirect or consequential loss, including but not limited to any loss of profit, loss of revenue, loss of use or loss of contract arising out of your enrollment to the Course, including without limitation any perceived breach of these Terms and Conditions.
- MahaVastu® reserves the right to reject or put on-hold your enrolment as may be required to comply with any legal and regulatory provisions, and also reserve the right to refuse access to the Course, remove content at any time without providing any notice to you, and/or reserve the right to disable any account, feature, or identifiers, whether chosen by you or provided by us, at any time if, in our opinion, the said identifiers or you have violated any provision of the mentioned Terms & Conditions.
- MahaVastu® does not accept any liability for any loss or additional expense caused by delay or disruption to travel services, weather conditions, civil disturbance, industrial action, strikes, wars, floods, sickness or force majeure. Such losses or additional expenses are your responsibility. Force majeure represents unusual or unforeseeable circumstances, which include: war, terrorist activities, riots, natural disasters or nuclear disasters such as fire, flood or adverse weather conditions.
Support and Contact:
- You may reach out to us on [email protected] for any issue/s faced by you during the Course. We will use our best efforts to resolve your issue/s. All decision/s on such issue/s will be at the sole discretion of MahaVastu® and final and binding on you.
Grievance Redressal:
- Any grievance, concern, or complaint arising out of or in connection with this Agreement shall be submitted in writing to the designated email address: [email protected]
- The grievance must be accompanied by all relevant documents, supporting information, and factual details necessary for MahaVastu® to assess the matter. Only grievances submitted with complete and adequate documentation will be considered for review and redressal.
- Upon receipt of a valid and complete grievance, MahaVastu® shall make reasonable efforts to address and resolve the issue in good faith. In the event that the grievance is not resolved within a reasonable period of time, the Parties agree that the matter shall be referred to arbitration in accordance with the Dispute Resolution clause stated hereinbelow.
Dispute Resolution
- All disputes, controversies, or claims arising out of or in connection with this Agreement, including any question regarding its existence, validity, interpretation, performance, breach, or termination, shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended from time to time). The arbitration shall be conducted by a sole arbitrator mutually appointed by the Parties.
- The seat and venue of arbitration shall be Delhi, India. The arbitration proceedings shall be conducted in the English language. The award rendered by the arbitrator shall be final and binding on the Parties.
Disclaimer:
- Participants who violate any mentioned Terms and Conditions, whether online or offline, will be removed from the course. The participant agrees that MahaVastu® reserves the right to remove any participant from the course without any reason whatsoever without any explanation on the sole decision of MahaVastu®. No refund shall be processed in such a case either.
Binding Contract:
- These Terms and Conditions are with respect to enrolment for the Course and for governing the basic relationship between MahaVastu® and You. You may be required to sign further Agreements may be shared with You, if the need is felt by MahaVastu®.
- These Terms and Conditions (and any dispute or claim relating to them) shall be governed by and construed in accordance with the laws of India. The Courts at New Delhi alone to the exclusion of all other Courts in the country shall have the jurisdiction over any disputes relating to these Terms and Conditions and any other issue emanating from the Course.
- Once you accept the Terms and Conditions you enter a contract between MahaVastu® and Yourself. MahaVastu® reserves the right to change any of the content, material, prices, offers or time period of the courses or products at any time without any intimation.
Addendum to Terms and Conditions of MahaVastu® Courses (wherever applicable)
Addendum 1: Offline Course Terms and Conditions
These terms & conditions are applicable to everyone attending the offline part of Hybrid Courses.
Offline Dress Code Policy:
- Participants are expected to dress in casual, business casual, smart casual or business attire unless course flow requires otherwise. Information regarding different dress codes will be shared with the participants during the course.
- Participants must always maintain a clean and professional appearance. Each participant is expected to be well-groomed and wear clean clothing, free of holes, tears, or other signs of wear.
- Clothing with offensive or inappropriate designs or stamps is not allowed. Clothing should not be too revealing. Clothing and grooming styles dictated by religion or ethnicity are exempt.
Dress Code Violations:
- Trainers and MahaVastu® team shall inform participants of dress code violation if needed during the course. Offending Participants (in violation of this Dress code policy) agree to immediately correct the issue when informed. This may entail having to leave the session to change clothes. Repeated violations or violations that have major repercussions may result in strict action being taken including termination of your enrolment in the course without refund.
Intellectual Property, Copyright, Content Protection:
- Any video or audio recording is strictly prohibited during the entire course duration. Use of recording devices, cameras, mobile phones etc. is strictly prohibited during course sessions and discussions, the participant agrees to be physically frisked for the same.
- The participant agrees that any and all such devices found in their possession will be confiscated and destroyed immediately without any discussion or appeal. The participant also agrees to heed to any disciplinary action taken against them by MahaVastu® Team within the confines of the law. Any discussions, excuses or appeals will not be entertained in this case and may result in immediate dismissal from the course including removal from premises, without any refund.
Behavioral Guidelines
- The Participant agrees to follow all written and verbal instructions without fail. Instructions may be communicated to them through multiple channels, including but not limited to:
- Instructions posted on Course groups by team or support trainers.
- Instructions from any lead Trainer and support trainers during the session.
- Guidelines from Hotel staff and any regulatory authorities (including but not limited to Covid-19 or similar Protocols)
- Propagation of any wrong information, rumors, hearsay, etc. during online or offline part of the course, on any channels and mediums provided by MahaVastu® or otherwise, will result in immediate termination of the offending participant from the course without refund. MahaVastu® reserves the right to take further legal action as deemed fit by MahaVastu® in response to such offenses.
- In case of any misdemeanor or misbehavior, including but not limited to behavior that is rude, abusive, intimidating, aggressive, vulgar, sexual harassment, propagates mis-information, etc. shall entail immediate termination from course and may also lead to criminal legal action. In such cases, the participant agrees to be expelled and removed from the course and the premises immediately. No request for refund of any amount shall be entertained.
Participant No Show Policy:
- All participants are expected to be present at and attend the entire course, including both Online and Offline sessions and any discussions during the course.
- During the registration phase of the course, MahaVastu® shall inform the participants of the reporting window along with other important information for smooth onboarding of the participant. In case a participant is late/early or unable to attend the reporting window, he/she shall inform the MahaVastu® team about the preferred time in advance with a valid reason. MahaVastu® team shall make best efforts to accommodate the participant for such registration. MahaVastu® also reserves the right to deny entry/registration to Participant at their requested time. In cases where the Participant cannot adhere to informed reporting/registration times, such delays may also amount to a no show at the discretion of MahaVastu® and such a decision shall be final and binding.
- If the participant is unable to attend the course due to any reasons whatsoever, MahaVastu® is not liable for any refund of the course fees. In such cases, if the participant chooses to receive the course kit, then the participant agrees to bear the associated expenses by paying relevant packaging charges, shipping charges, courier charges and any other convenience fees associated with the same in advance.
- Participants who violate any mentioned Terms and Conditions, whether online or offline, will be removed from the course. The participant agrees that MahaVastu® reserves the right to remove any participant from the course without any reason whatsoever without any explanation on the sole decision of MahaVastu®. No refund shall be processed in such a case either.
Addendum 2: Partial Payment
- Due to the transaction limit restrictions applicable on UPI and other payment options under the relevant guidelines, MahaVastu® offers a partial payment option to facilitate your enrolment process.
- You shall pay part of the payment of your selected course as initial payment and pay the balance amount within 72 (seventy-two) hours from the time of the initial payment depending upon your choice of installments and amount calculated on the enrolment summary page.
Please note that:
- Enrolment shall not be confirmed till complete payment has been made.
- Failure to pay the balance amount within the stipulated time, i.e. 72 hours of the initial payment shall result in automatic cancellation of your registration.
- In such a case, the initial payment made by you shall not be refunded. It can be adjusted as prepayment against one future instance of the same or other course, with your consent.
- It is your responsibility to ensure timely completion of the full payment within the allowed period.
- MahaVastu® shall not be liable for any failure in payment processing caused due to user-end issues, banking limitations, or platform restrictions.
- MahaVastu® reserves the right to change/revise pricing of its courses at any time which shall be applied to everyone enrolling after such price change and not on the existing paid users who have paid in full or have paid the initial payment availing Partial Payment Plan.
Addendum 3: Wait List Policy
This policy governs the procedure for managing participants who wish to join a MahaVastu® Course that has reached full capacity. The Wait List ensures fair opportunity and structured admission for all interested candidates.
- Eligibility for Wait List:
A participant will be added to the Wait List only upon completion of full payment for the desired course. Partial payments or unpaid applications shall not qualify for placement on the Wait List. - Wait List Order and Notification:
Wait List positions are allocated on a first-paid, first-listed basis. If a seat becomes available, MahaVastu® shall notify the participant through Email/SMS/Whatsapp/Phone or any other suitable medium. Participants must confirm their intent to occupy the available seat within 48 hours of notification; failure to do so will result in forfeiture of the slot. - Confirmation and Withdrawal:
Once a participant accepts the Wait List offer and is confirmed for the course, withdrawal from participation will result in forfeiture of the full course fee. However, the participant may opt to transfer the paid amount to one future MahaVastu® Course of equivalent or higher value, to be utilized within 12 months, subject to availability and management approval. - Rejection and Refund:
If a participant on the Wait List is not selected or no seat becomes available before course commencement, the full payment will be refunded within 10 business days through the same mode of payment. - Transfer and Adjustments:
Participants on the Wait List may request a transfer to another course’s Wait List of similar or higher level. Such transfer requests must be made before acceptance into any course and are subject to MahaVastu®’s discretion. - Non-Refundable Conditions:
If a participant withdraws voluntarily after being offered and accepting a Wait List seat, the payment shall be strictly non-refundable. Adjustments are permissible only as outlined above. - Administration and Policy Updates:
MahaVastu® reserves the right to amend, suspend, or discontinue the Wait List policy at any time without prior notice. Any modifications will apply prospectively and will not affect existing confirmed Wait List participants.
Addendum 4: Nadi Check Policy
The Nadi Check ensures that only suitable candidates, possessing the requisite balance of energies and readiness for advanced learning, are admitted.
- Eligibility & Payment
Only candidates who pass the Nadi Check conducted personally by Dr. Khushdeep Bansal are eligible for specific advanced courses. Each candidate must pay the amount as specified on the payment screen during the purchase of course prior to scheduling the assessment which shall be treated as Part Payment towards the course selected.Once the participant passes the Nadi Check, this part payment shall be adjusted against the complete fees payment of the course. In case of withdrawal from the course after passing the Nadi Check by the participant, the payment so made shall be non-refundable but adjustable as prepayment against one future instance of same or other course, with mutual consent between MahaVastu® and the Participant.
- Assessment Procedure
The Nadi Check is conducted personally and exclusively by or under direct guidance of Dr. Khushdeep Bansal.
It involves observational, intuitive, and energy-based evaluations. In no case should any observation be considered as any medical advice and be subjected to explanation. Nadi Check does not amount to any personal comment against anybody.
The decision of Dr. Khushdeep Bansal is final, binding, and non-contestable. No appeals or reviews will be entertained. - Refund Conditions
If a candidate fails the Nadi Check, the entire amount paid by the participant shall be refunded.
In case of course cancellation by MahaVastu®, the full amount will be refunded.
Refund initiation will begin within 24 working hours of the decision. MahaVastu®’s responsibility will be limited to informing the payment gateway within 24 hours to enable the payment gateway to process the refund through their appropriate channels. Any delay after refund initiation due to any reason whatsoever is not the responsibility of MahaVastu.
Under no circumstances shall MahaVastu® be held liable for any loss occasioned to you on account of Nadi Check Failure. - Scheduling & Conduct
Nadi Checks are scheduled as per Dr. Khushdeep Bansal’s availability.
Failure to attend without 48-hour prior notice results in forfeiture of the amount paid by the participant during enrolment of the course in which case the amount shall also be non-adjustable. - Disclaimer
The Nadi Check is not a medical or psychological evaluation but a proprietary energy-based process.
Participation is voluntary and with consent and subject to Dr. Khushdeep Bansal’s spiritual and intuitive discretion.
Acknowledgement
By proceeding, you acknowledge that you have fully read and completely understood these Terms and Conditions including addendums wherever applicable and agree to abide by them. You confirm and declare that you have voluntarily, of your own free will and without coercion or any undue influence on the part of MahaVastu® consented to the present Terms and Conditions and are remitting the non-refundable Course fee.
