These terms and conditions (Read till end to enable Pay Now button) are a contract between You (“User”) and MahaVastu Corporation LLP (“MahaVastu®”). These T&C contain very important information about your rights and obligations as well as limitations and exclusions that may apply to You.
Terms of Use of this Website & related Content:
This website is owned and operated by “MahaVastu Corporation LLP” under the brand name “MahaVastu®”. The company name will be referred to as “MahaVastu®” herewith.
All intellectual property rights, including copyright in all content and communication of the Website and material thereto belongs to “MahaVastu®”. By reading the Terms of Use you are agreeing that the content and property of “MahaVastu®” cannot be copied, reproduced, modified, stored, redistributed, or exploited commercially in any way without permission from “MahaVastu®”.
“MahaVastu®” may change the content, which includes prices, offers and content at any time. We do not provide a warranty or guarantee of its accuracy, completeness, suitability, timeliness or performance of information or content in the website. If there are errors in the information provided in the content of the website, we expressly exclude liability for these inaccuracies, to the fullest extent that the law permits.
You can use any of the information or content at your own risk for which “MahaVastu®” will not be liable. It will be your responsibility to ensure that any products you purchase are suitable to your current requirements.
Description of Product – Vedic Astrology:
Vedic Astrology - Horoscope is a Product accessible through the website *.mahavastu.com. It allows the User to upload certain variable information on the program and using an algorithm generates a horoscope report on the website that is downloadable. Thus, the website program delivers a downloadable report to User.
‘Vedic Astrology – Horoscope’ (The Product) is a structured report to aid in the reading of a horoscope. These Reports are for illustrative purposes only and any and all interpretations made from the Product are the responsibility of the User and not the Company.
The techniques of horoscope reading imparted in the Product ‘Vedic Astrology – Horoscope’ are based on algorithmic interpretation of text-based knowledge and The Company does not take any responsibility in the accuracy, usefulness or appropriateness of the information generated by the Product.
MahaVastu® shall not be responsible for the ‘Interpretations’ of the Horoscope done by the User or any other Party. The said reading of horoscope shall not be relied upon by You for any advisory / commercial purpose. It is not a definitive reading.
MahaVastu® shall not be liable for damage caused to User system due to download of Horoscope Report or use of Program or for any other reason whatsoever.
MahaVastu® can change the Product, Product Interface, Algorithm, User Fee, Website access, terms and conditions at any time without prior intimation to the User. By Agreeing to use the Program as offered, you agree to all such modified terms and conditions and accept all updates applied to the Product.
User Fee:
Before information is fed into the Program to render a Horoscope reading, each User has to pay a (non-refundable, non-cancellable) fee to use the Program. The User fee that is charged by MahaVastu® that is displayed on the website is subject to change without intimation to the User.
Once a User pays the Fee for using the Program, the said Fee is not refundable. Once the User pays for a single transaction, User is entitled to use Program to access a single Horoscope Report. There is no cancellation of Order.
In the unlikely event of double payment due to payment gateway error or malfunction or internet not displaying successful payment gateway, User may contact MahaVastu® at helpdesk@mahavastu.com. MahaVastu® shall check with the payment gateway and If MahaVastu® has not received the payment, it shall ask Payment Gateway to reverse one transaction if the payment gateway has not already done so on its own accord. In case MahaVastu® has received payment twice for one transaction, in that case User account on website, shall allow User to access two Horoscope Readings.
MahaVastu® can change the User Fee applicable per Horoscope reading at any time without prior intimation to the User.
Intellectual Property:
All materials and content, which include images, text, layout, graphics, design and appearance on the website *.mahavastu.com belong to “MahaVastu®”. Their reproduction in either copied or derivative format or disparaged format is illegal. Any breach of these terms may result in a criminal offense being committed, in addition to a claim for damages.
MahaVastu® Trademarks on the website vest with MahaVastu® Corporation LLP and cannot be reproduced by the User without permission.
Copyrights in the Program and Website vest with MahaVastu® Corporation LLP and cannot be reproduced by the User without permission. Posting of the downloadable reports generated by the Program on the Internet or social media or social chat apps is not allowed. Civil and Criminal action shall be taken for violations of the same.
Confidential Information/ Proprietary Information:
You agree to make use of the Confidential Information/ Proprietary Information (‘Confidential Information’ or ‘Proprietary Information’ shall include any publication or article or data or information or material through any medium shared with you whether or not the same is novel, unique, patentable, copyrightable, or constitute a trade secret) solely for the purpose intended and in connection with the current or contemplated association between MahaVastu® and You and not for any purpose, unless otherwise authorized by prior written consent by an authorized representative of MahaVastu®.
There shall be no right or license, whether expressed or implied, in the Confidential Information/ Proprietary Information disclosed to you at any point of time. Ownership and title to the Confidential Information/ Proprietary Information shall remain solely with MahaVastu®. Further, you shall not use or attempt to use any of the Confidential Information/ Proprietary Information in any manner which may cause or be calculated to cause injury or loss to MahaVastu® and shall be met with Legal Action.
Limitations of Liability on MahaVastu® & Obligations on User:
You recognize and agree that no promises and/or representations and/or assurances have been held out to you as to how you would fare professionally after getting the Horoscopes from the Program.
You are aware and accept that the Program is a stepping stone to interpreting Vedic Astrology – Horoscope Reading on your own intellect and understanding of the subject. MahaVastu® shall not be liable for any misunderstanding of the subject by the Users.
MahaVastu® does not guarantee any results from the Program or the techniques and learnings disseminated in the Program. Like any other professional service, the methodology used by MahaVastu® also requires skills in application and expert advice under regular observation of a subject matter expert.
MahaVastu® does not guarantee, ensure or promise learning by You in understanding and mastering of skills in Vedic Astrology. Learnings from the Vedic Astrology Foundation Course and/or from the Vedic Astrology Horoscope or any other related products/ programs provided by MahaVastu® solely depend upon Your own understanding, intellectual capability, personal approach, ability to comprehend and practice of taught procedures. MahaVastu® is imparting the knowledge but not guaranteeing that You imbibe and learn the same in the manner taught to You.
Since the Program is self explanatory there is no further information, tools, material, etc. required to be given by MahaVastu® in relation to the Program. Instructions to use the Program are imparted in various course(s) conducted by MahaVastu®.
Vedic Astrology is a broader knowledge about horoscope theories from ancient India. Vedic Astrology knowledge is a collection of ideas and concepts, with or without the support of diagrams, charts and tables. Rather, these ideas and concepts are dependent on certain factors, such as time, date and place of birth of an individual and the planetary positions coinciding with that information which are interpreted together to give a Horoscope Reading.
MahaVastu® has unfettered right and can at its sole discretion, without giving any warning, intimation, written notice and/or assigning any reason whatsoever to prohibit you from using the Program and/ or accessing the material / information used in the Program and sharing it to social networking group/s and/ or digital social media platform/s managed by MahaVastu® at its sole discretion, without giving any warning, intimation, written notice and/or assigning any reason whatsoever.
MahaVastu® shall not, in any circumstances be liable to you for any special, indirect or consequential loss, including but not limited to any loss of profit, loss of revenue, loss of use or loss of contract arising out of usage of the Program, including without limitation any perceived breach of these Terms and Conditions.
MahaVastu® does not accept any liability for any loss or additional expense caused to User by weather conditions, civil disturbance, industrial action, strikes, wars, floods, sickness, pandemic or government-controlled lockdowns or force majeure. Such losses or additional expenses are responsibility of User. Force majeure represents unusual or unforeseeable circumstances, which include: war, terrorist activities, riots, pandemics, natural disasters or nuclear disasters such as fire, flood or adverse weather conditions.
Support and Contact:
In the event that User wishes to contact MahaVastu® for technical help w.r.t. the website; the algorithm, then User may do so on helpdesk@mahavastu.com. MahaVastu® shall endeavour to give response, support, as required within 15 days from raising of query. All decision/s on such issue/s will be at the sole discretion of MahaVastu® and final and binding on you.
Usage of Data / Personal Information:
While using the Program, it is understood that the User will be entering data personal to the User or a Third-Party. It is clearly understood by the User and the General Public that other than for keeping record of the readings that have been issued by the Program, the data that involves birth time and birth date is going to be stored on the website and/or its servers.
The User can access all reports generated by him/her in the Program by accessing the MyAccount tab. Records on the MyAccount page of a User are sorted through Name, Date of Birth and Time of Birth.
That other than for record keeping, this personal data involving date of birth, time of birth and place of birth shall not be shared by MahaVastu® with third-parties. However, in the case of a security breach of the Servers of MahaVastu® and access of this information going to a Third-Party, MahaVastu® shall have no liability towards use of data by such Third-Party. Similarly, in the case the Account of the User is compromised and data from MyAccount tab is accessed by a Third-Party, MahaVastu® shall have no liability towards use of data by such Third-Party.
The website *.mahavastu.com” does not store the User's financial information. The website stores User’s basic profile details and keeps a basic log of horoscope reports generated by the Program.
MahaVastu® reserves the right to contact User through its registered email ID and mobile number in case of any account related information, Product related information; or marketing related information.
Governing Law & Dispute Resolution:
These Terms and Conditions (and any dispute or claim relating to them) shall be governed by and construed in accordance with the laws of India. The Courts at New Delhi alone to the exclusion of all other Courts in the country shall have the jurisdiction over any disputes relating to these Terms and Conditions including injunctive relief due to infringement of Intellectual Property and any other issue emanating from the use of the Program.
Binding Contract:
These Terms and Conditions are with respect to Usage of the Program and for governing the basic relationship between MahaVastu® and You. You may be required to sign further Agreements may be shared with You, if the need is felt by MahaVastu®.
Once you accept the Terms and Conditions you enter a contract between MahaVastu® and Yourself (User). MahaVastu® reserves the right to change any of the content, material, prices, offers or time period of the Program at any time without any intimation.
